Role Overview:
Provides commercial Expertise to the business (in line with Capgemini’s commercial and legal policies) to sell profitable deals and manage commercial and contractual risk.
Is a key member of the bid team on new business sales and large renewals and extensions to existing deals but may also provide support to ongoing engagements where additional strong commercial skills are required e.g. add on business, change control, dispute management and resolution.
Participates in negotiation of contracts with clients and/or subcontractors.
General Responsibilities / Accountabilities:
Typically engaged on small to medium deals in lead or support role as appropriate to capability and experience.
Supports the bid team in selling profitable business in line with SBU/Group targets and that does not put Capgemini at a disproportionate level of risk through commercial shaping of deals and defining commercial and negotiating strategy.
Engaged in reviewing, drafting, marking up contracts and all commercial documents (e.g. terms & conditions, schedules, service level agreements, subcontracts, etc.) as required, working closely with, and advising Sales, Legal, Delivery, HR and other members of the bid team as appropriate.
Prepares documentation for and participates as necessary in geography/BU/SBU/Group Risk deal reviews.
Ensures that a comprehensive handover is provided to the ongoing delivery team so that they have dull understanding of the contractual obligations and the commercial shape of the deal including working with the delivery team (typically on a part-time basis) for an agreed period following contract signature.
Challenges sales/solutions/IT where necessary and in an appropriate manner to ensure commercial risk is adequately mitigated without harming competitiveness of bid.
Manages and aids in the development of at least one junior member of the team.
Qualifications (Education/Experience/Certification):
No essential formal qualifications however role holder must have:
An awareness of typical terms and obligations found in outsourcing contracts (including specific variations that may apply to a particular market/geography because of legislation/regulation or common practice e.g. ARD, Sarbanes Oxley/SAS70, EU Data Protection, Financial Distress, etc).
An awareness of Capgemini preferred commercial and legal positions.
Experience of client facing negotiations.
Completed recommended internal (and on occasions external) commercial and negotiation training as may be recommended from time to time to ensure skills and market knowledge remain up to date.
